By accessing or using VibeGuardian ("the Service"), operated by AB Tech Drummondville, a sole proprietorship registered in Quebec, Canada, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
You represent and warrant that you are at least 18 years of age (or the age of majority in your jurisdiction, whichever is greater) and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
VibeGuardian is a software-as-a-service (SaaS) platform that performs automated security audits on source code repositories. The Service:
You may create an account using GitHub OAuth, Google OAuth, or email magic link. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must not share your account with third parties. You agree to notify us immediately at support@vibeguardian.dev if you suspect unauthorized access to your account.
VibeGuardian uses a wallet-based, pay-per-MB metered billing model. You top up your wallet with US Dollars via Stripe Checkout (one-time payment, with a volume bonus on tiers ≥ $50). Each completed scan debits the wallet based on the actual scannable size we observe after cloning your repository, at the published per-MB rate for the chosen Level (Level 1 Haiku 4.5 at $1.50/MB, Level 2 Sonnet 4.6 at $3.00/MB, Level 3 Opus 4.7 at $6.00/MB, with a 1 MB minimum). Level 0 (Fixed Rules Only · scanners-only, no LLM audit) remains free and is rate-limited to five scans per calendar month for users without any prior top-up.
Wallet credits are valid for 30 days from the date of each top-up and drain oldest-first when scans run (Expiration-First). The full per-MB price for any given scan is quoted on screen before the LLM passes start; if the actual size exceeds your wallet, the scan is refused with no charge. All prices are in US Dollars (USD). Payments are processed securely by Stripe, Inc. By topping up, you authorize us to charge your selected payment method for the amount shown at checkout.
You are solely responsible for any applicable sales tax, use tax, VAT, or similar taxes imposed by your jurisdiction on the purchase of digital goods. Promotional discounts (if active) are applied at checkout and may be subject to expiration dates or usage limits.
Upon successful completion of a scan and the corresponding wallet debit, your security report is generated and delivered immediately as a downloadable PDF. The report is also sent to your registered email address. Reports are stored on our servers for 14 days from the date of generation, after which they are permanently deleted for your privacy. You are encouraged to download and save a local copy promptly. Wallet top-ups are likewise considered delivered the moment the corresponding wallet credit lands in your account (typically within seconds of Stripe confirming the payment).
Please refer to our Refund Policy for complete details. In summary: because the Service delivers digital goods immediately upon payment, all sales are final once the report has been generated and delivered. Exceptions are outlined in the Refund Policy.
Your source code is cloned or extracted into a temporary, isolated directory, scanned, and deleted within minutes of scan completion. We do not store, retain, or share your source code after the scan is complete. Only the scan results (findings, scores, metadata) are retained in our database. By submitting source code to the Service (via repository URL or .zip upload), you grant AB Tech Drummondville a limited, non-exclusive, temporary, revocable license to:
This license terminates automatically upon completion of the scan and deletion of your source code from our servers (within minutes). This license does not grant us any ownership rights over your code, nor any right to use your code for any purpose other than providing the Service. We do not sublicense, distribute, or publicly display your code.
The security audit includes findings generated by artificial intelligence (AI) models. The AI-generated content is provided on an "AS IS" and "AS AVAILABLE" basis, without warranty of any kind, express or implied, including but not limited to warranties of accuracy, completeness, fitness for a particular purpose, or non-infringement.
AI-generated findings may contain errors, false positives, false negatives, or incomplete information. The Service is provided as a supplementary security tool and does not replace professional security audits, penetration testing, manual code review, or legal compliance reviews.
VibeGuardian makes no guarantee that the audit will identify all vulnerabilities in your code. A passing score or high grade does not certify that your application is secure. You remain the sole party responsible for the security of your code, your infrastructure, and your deployment practices. You are solely responsible for reviewing and testing any suggested changes before deploying them to production.
AB Tech Drummondville is not responsible for any damage, data loss, security breach, downtime, or regression caused by: (a) applying the suggested code fixes; (b) relying on the audit results as a sole measure of security; or (c) any vulnerability that the Service failed to detect.

We reserve the right to suspend or terminate your account without notice if we determine, in our sole discretion, that you have violated these Terms.
We respect the intellectual property rights of others. If you believe that content accessible through our Service infringes your copyright, you may submit a DMCA takedown notice to our designated agent:

You agree to indemnify, defend, and hold harmless AB Tech Drummondville and its owner, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property rights; or (d) any content you submit to the Service.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AB TECH DRUMMONDVILLE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, REVENUE, PROFITS, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
THE TOTAL AGGREGATE LIABILITY OF AB TECH DRUMMONDVILLE FOR ANY AND ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO AB TECH DRUMMONDVILLE DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

Any dispute, claim, or controversy arising from or relating to these Terms or the Service shall be resolved through binding individual arbitration administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules. The arbitration shall be conducted in English.
Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against AB Tech Drummondville.
Small Claims Exception: Either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits.
Opt-Out: You may opt out of this arbitration agreement by sending written notice to support@vibeguardian.dev within 30 days of first using the Service. Your notice must include your name, email address, and a clear statement that you wish to opt out of the arbitration provision.
Security audit reports generated by the Service are delivered as non-editable PDF documents. Each report includes a unique Scan ID, generation timestamp, and checksummed metadata to ensure document integrity.
If you intend to use a VibeGuardian report as evidence of due diligence or security compliance, you should be aware that the probative value of a technological document depends on its integrity being maintained from creation to presentation. For users in Quebec, this is governed by article 2838 of the Civil Code of Quebec and article 15 of the Act respecting the legal framework for information technology (LCCJTI). We recommend downloading and archiving your report immediately upon generation to preserve its integrity chain.
AB Tech Drummondville does not provide legal certification, notarization, or attestation services. Reports are provided as informational tools only and do not constitute a legal guarantee of security compliance.
The VibeGuardian platform, including its design, code, branding, AI audit methodology, and all related intellectual property, is owned by AB Tech Drummondville and is protected by copyright, trademark, and other applicable laws. Your security reports are yours — you may use, share, and distribute them as you see fit.
The Service is hosted and operated from North America. You agree not to access or use the Service from any country or territory subject to US (OFAC), Canadian, or international trade sanctions. You represent that you are not named on any US government list of prohibited or restricted parties.
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. For disputes not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in the State of Delaware.
For users located in Canada, these Terms are additionally subject to the applicable laws of the Province of Quebec and the federal laws of Canada, to the extent required by applicable law.
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Service after the posting of revised Terms constitutes your acceptance of the changes. If we make material changes, we will make reasonable efforts to notify you (e.g., via email or a notice on the Service).
